Employment at Will Doctrine

Illinois follows the doctrine of employment-at-will. Under the doctrine of employment-at-will, an employer can fire an employee for any reason, including unfair reasons. The employment-at-will doctrine is the general default rule that the Illinois and Federal courts apply unless the employment-at-will doctrine has been modified by contract or an exception applies.

Employers cannot fire employees for an illegal reason

A major exception to the employment-at-will doctrine is that an employer cannot fire an employee for a reason that is considered illegal under Illinois or Federal law. Common examples of an illegal reason for terminating an employee under Illinois and/or Federal law would be a discriminatory reason in violation of Illinois or Federal anti-discrimination statutes, refusing sexual advances, reporting sexual harassment or employment discrimination, engaging in certain activities that are considered protected under Illinois and Federal laws, engaging in certain whistleblowing activities that are protected under Illinois and Federal laws, and refusing to engage in conduct that would be in violation of Illinois or Federal law. Know the reasons why your employment was terminated

Make sure to you get your employer’s reason or reasons for your termination at the time of your termination. Try to get your employer to put the reason(s) for your termination in writing. Record the date of your termination. The date your employment was terminated is very important because the statutes of limitation which limit the amount of time time you have to file a claim under certain Illinois or Federal laws can be as little as 30 days. If you suspect your employer terminated your employment in violation of Illinois or Federal law, you should seek an immediate legal consultation.
